8.1. Team Hosting
1. Eligibility and Structure Companies, teams, partnerships, or organizations may register properties or services under a single Choira account for the purpose of hosting. The account must be created and operated by an authorized representative of the entity, who assumes full responsibility for compliance with all Choira policies, Indian laws, and applicable regulations.
- o Companies, teams, partnerships, or organizations may host under a single Choira account.
- o The account must be operated by an authorized representative responsible for legal and platform compliance.
2. Primary Host Responsibility The designated primary host or account holder is accountable for ensuring listing accuracy, legal eligibility, and proper management of co-hosts, employees, or team members. They must also ensure full compliance with Choira Terms and Conditions and local laws.
- o Ensure listings are accurate and legally eligible for hosting.
- o Manage co-hosts, employees, or team members operating under the account.
- o Ensure compliance with Choira policies and all applicable laws.
- o Misconduct or policy breaches by team members will be attributed to the primary host or organization.
3. Authorized Operations All contracts, payments, and official communications with Choira must be conducted by duly authorized representatives of the entity.
- o Choira may request proof of authorization, such as a power of attorney, company authorization letter, or board resolution.
4. Transparency and Record-Keeping Organizational hosts must maintain accurate internal records of team assignments, payouts, and tax filings.
- o Choira may require verification of business details such as GSTIN, PAN, CIN, or trade license to ensure compliance with Indian business laws.
8.2. Organizational Liability
1. Accountability of the Organization The company, organization, or business entity registered on Choira is fully responsible for all activities conducted under its hosting account, including the accuracy of listings, guest interactions, dispute resolution, and compliance with applicable Indian laws, regulations, and licensing requirements.
- o Ensure the accuracy of listings and representations made to guests.
- o Manage guest interactions, communications, and dispute resolution.
- o Comply with all applicable Indian laws, regulations, and licensing requirements.
2. Legal and Regulatory Compliance The organization must ensure compliance with all statutory and regulatory obligations.
- o Labor laws governing employees, contractors, and freelancers engaged in hosting activities.
- o Goods and Services Tax (GST) registration, invoicing, and remittance.
- o Income tax reporting and any applicable local or municipal regulations relevant to hosting operations.
3. Training and Oversight The organization must provide adequate training to all employees, co-hosts, and representatives involved in hosting or guest interactions.
- o Ensure professional behavior and alignment with Choira’s standards.
- o Maintain awareness of safety, hygiene, and guest service protocols.
- o Ensure compliance with legal, operational, and tax obligations.
4. Shared Liability The organization and its authorized representatives shall be jointly and severally liable for any breach of Choira’s Terms and Conditions, guest disputes, or violations of Indian law arising from hosting activities.
- o Choira may suspend, withhold payouts, or delist organizational accounts found in violation of platform rules or legal requirements.
9. Risks and Limitations
1. General Hosting Risks Hosting through Choira involves operational and legal risks, including property damage, guest disputes, personal injury, or liability claims. External factors such as infrastructure limitations, natural hazards, social or political events, or regulatory changes may also impact hosting operations.
o Property damage, disputes, personal injury, or liability claims.
o Infrastructure issues such as water, electricity, or internet interruptions.
o Natural disasters, social events, or regulatory changes.
2. Due Diligence and Compliance Before listing your property, studio, or service, you must conduct thorough due diligence.
o Review local and state-level regulatory, safety, and licensing requirements.
o Assess insurance needs for property, liability, and business interruption.
o Ensure compliance with community or housing society by-laws.
3. Independent Responsibility Hosting is undertaken at your own risk, and you are solely responsible for ensuring compliance with all applicable Indian laws and regulations.
o Choira does not verify legal status, ownership, or safety compliance of listings.
o Choira does not provide insurance or indemnity unless explicitly stated.
4. Limitation of Platform Liability Choira functions solely as a facilitating platform and is not liable for issues outside its control.
o Third-party actions or omissions, including those of guests or service providers.
o Compliance failures or legal violations by hosts or guests.
o Accidents, damages, losses, or interruptions caused by external events.
10. Support, Resources, and Continuous Compliance
10.1. Choira’s Role
1. Platform Support and Guidance o Choira provides hosts with support services, informational resources, and compliance guidance to help facilitate smooth hosting operations. o These resources may include help articles, webinars, policy updates, and best-practice recommendations tailored to Indian hosting requirements. 2. Host Responsibility o While Choira offers general guidance, hosts remain solely responsible for their own legal, tax, and business compliance under applicable Indian laws. o Hosts must ensure that all property, business, and tax-related obligations are fulfilled independently and accurately. 3. Policy and Legal Updates o Hosts are required to regularly review Choira’s platform policies and stay informed about changes in local, state, or national laws that may impact hosting activities. o Continued use of the platform implies acceptance of any updated terms or compliance standards introduced by Choira.
10.2. Regular Review and Training
1. Continuous Learning o The hospitality and creative services landscape in India evolves rapidly. Hosts are encouraged to stay updated on regulatory, taxation, and safety requirements that may affect their listings. 2. Training and Professional Support o Choira periodically offers training programs, webinars, and educational resources to help hosts maintain professional standards and legal compliance. o Hosts should also seek guidance from qualified legal, accounting, or compliance professionals when necessary to ensure adherence to applicable laws. 3. Commitment to Professionalism o By remaining informed, proactive, and compliant, hosts contribute to a trusted, secure, and high-quality ecosystem on the Choira platform.
1. Payment Collection.
Choira Payments generally collects the Total Price of a booking at the time the Guest’s booking request is accepted by the Host, unless noted otherwise. The Total Price collected by Choira Payments includes all amounts due—such as the base price set by the Host, Choira’s service fee, and any applicable Indian taxes or statutory levies (including but not limited to GST, TDS, occupancy taxes, and other charges as required by Indian law). All transactions are processed through RBI-compliant payment systems, and payouts to Hosts are subject to applicable KYC, AML, and tax withholding requirements under Indian regulations. Where required by law, Choira may deduct applicable taxes at source and remit such amounts to the relevant authorities. The balance, after all applicable deductions, will be disbursed to the Host as per Choira’s payout schedule and subject to confirmation of successful guest check-in or service provision. If an exception to the standard payment process applies, such exception will be specified in the Listing and must comply with Indian laws, regulations, and Choira’s policies.
2. Valid Payout Method.
2.1.
To receive a payout, you must have a valid Payout Method linked to your Choira account. When you add a Payout Method to your Choira account, you may be required to provide additional information such as your name, government-issued identification, tax ID (such as PAN or GSTIN), billing address, and details of your financial instrument either to Choira Payments or its authorized third-party payment processor(s). The information required may vary depending on the selected Payout Method and can include: residential address, name on the account, account type, bank IFSC code, account number, email address, payout currency, identification number, and account details associated with a particular payment processor. Providing all requested information is required for a Payout Method to be considered valid under Indian laws and banking regulations. The information Choira Payments requires for a valid Payout Method may change periodically, and additional details may be requested at any time to comply with prevailing legal, KYC (Know Your Customer), or AML (Anti-Money Laundering) regulations. Failure to provide the requested information may result in Choira Payments temporarily placing a hold, suspending, or canceling any payout until the information is provided and, if necessary, validated in accordance with Indian laws and Choira’s policies.
2.2.
You authorize Choira Payments to collect and store your Payout Method information in accordance with Choira’s Privacy Policy. Choira Payments may also disclose or share your payout information with governmental authorities as required to comply with applicable Indian laws and regulations.
3. Timing of Payout
3.1.
Unless you are a Host covered under Section 3.3.3 (in which case that Section applies to you), and subject to and conditional upon successful receipt of the associated payments from the Guest, Choira Payments will initiate payouts to your selected Payout Method as follows:
3.2.
Choira Payments may offer you a different payout time or trigger for payment through the Choira Platform. The time it takes to receive payouts once released by Choira Payments may depend upon the payout method you select.
3.3.
For Accommodations only, for: Hosts who do not have two completed stays, unless they have verified at least one listing, or Hosts in breach of these Payment Terms, the Terms, Additional Legal Terms, Policies, or our Standards, or if Choira believes it is reasonably necessary to protect Choira, its Members, or third parties, subject to and conditional upon successful receipt of the associated payments from the Guest, Choira Payments will initiate payouts to your selected payout method by the end of the business day after the Guest’s scheduled check-out date. If the Accommodation booking is twenty-eight (28) nights or more, Choira Payments will generally initiate the first and second payout together, 28 days after the Guest’s scheduled check-in date, and will initiate future payouts monthly after that for the duration of the reservation. All payouts and scheduling are subject to applicable Indian law, banking regulations, and Choira’s compliance policies.
3.4.
Your payout schedule will be displayed in your earnings dashboard on the Choira Platform.
4. Payout.
Your payout for a booking will be the Total Price less any fees, applicable Indian taxes, and any amounts you agree to allocate to any co-host, the owner(s) of an studio, a studio owner association, and/or their agent (such as a building operator or property management company). In the event of cancellation of a confirmed booking, Choira Payments will remit the amount you are due (if any) as provided in the Terms and the applicable cancellation policy.
5. Payout Restrictions.
Choira Payments may temporarily place a hold, suspend, or cancel any payout for the purposes of preventing unlawful activity or fraud, conducting risk assessments, ensuring security, or completing an investigation; or if we are unable to verify your identity or, where applicable, the identity of your representative(s) or beneficial owner(s), or to obtain or verify requested information under Indian KYC and AML laws. Furthermore, Choira Payments may temporarily place a hold on, suspend, or delay initiating or processing any payout due to you under the Terms as a result of high volume booking cancellations or modifications arising from a Force Majeure Event or as required by Indian law or regulatory authorities.
6. Payout Currency
Choira Payments will remit your payouts in the currency applicable to your selected payout method. The currencies available may be limited for regulatory or operational reasons, based on factors such as your payout method, your country of residence, and/or your Choira contracting entity(ies). Any such limitations will be communicated via the Choira Platform, and you will be prompted to select a different currency or payout method if necessary. Please note that payment service providers may impose transaction, currency conversion, or other fees based on the currency or payout method selected. Choira Payments is not responsible for these fees and disclaims all liability in this regard.
7. Limits on Payouts.
For compliance or operational reasons, Choira Payments may limit the amount of a single payout. If you are due an amount above that limit, Choira Payments may make a series of payouts (potentially over multiple days) in order to remit your full payout amount. Any such limits or procedures will be communicated to you through the Choira Platform and will comply with Indian regulatory requirements.
8. Payment Service Providers.
Payout methods may involve the use of third-party payment service providers. These service providers may charge you additional fees when processing payouts in connection with Choira Payment Services (including deducting charges from the payout amount), and Choira Payments is not responsible for any such fees and disclaims all liability in this regard. Your payout method may also be subject to additional terms of use from such third-party payment service providers. Please review all applicable terms before using your payout method.
9. Your Payout Method, Your Responsibility.
Choira Payments is not responsible for any loss suffered by you as a result of incorrect payout method information provided by you.
10. Abandoned Property
10.1.
If Choira Payments holds funds due to you and has not been able to successfully make payment to you for those funds ("Abandoned Property") in accordance with Section 7.2, we may, subject to applicable Indian law and the relevant limitation period, retain the Abandoned Property which would otherwise have been due to you and you will no longer have a claim for it.
10.2.
Subject to applicable law, funds held for you by Choira Payments will be considered Abandoned Property where any of the following apply:
1. Purpose and Applicability of the Guarantee
The Choira Property Damage Guarantee is designed to provide studio owners with financial reassurance during bookings made through the Choira platform. It offers compensation for certain unforeseen physical damage to studio spaces and their contents, which can be caused by guests or their attendees during a valid booking. When a guest fails to pay for damages, studio owners may rely on this Guarantee to cover specific losses. Importantly, the protection offered is limited only to bookings registered on the Choira platform and applies solely to studios located within India. Studio owners should note that this Guarantee does not function as an insurance policy and is not a replacement for traditional studio insurance. The intention is to supplement not substitute your own risk management strategies.
2. Eligibility Requirements for Studio Owners
Studio owners must meet defined eligibility criteria to qualify for coverage under the Choira Guarantee. Only those who adhere to these prerequisites may receive reimbursement for property damage. To begin with, your studio must be properly listed on the Choira platform, and every protected booking must be processed through Choira. Direct bookings or any arrangements made outside of the platform will not be covered. Furthermore, maintaining an active Choira account in good standing is essential. This includes following the Choira Services Agreement and abiding by the Community Guidelines at all times. Studio owners are responsible for the general upkeep, security, and accurate listing of their premises, as well as for maintaining up-to-date inventories of equipment, furnishings, and other property assets within the studio.
3. Types of Studio Property Protected by the Guarantee
The Guarantee covers particular categories of studio property present in the booked space during an eligible booking. Tangible assets that are owned by the studio owner and reside within the studio are included. This broad category covers essential equipment such as cameras, microphones, musical instruments, lighting units, props, and other fixtures commonly found in studio settings. Additionally, any permanent installations or improvements—mirrors, floors, shelves, acoustic panels—are safeguarded if required for the functioning of the studio. Personal property belonging to the studio owner that is located within the studio at the time of booking also falls within the scope of protection, provided these items are not accepted by other terms.
4. Items and Events Not Protected (Guarantee Exclusions)
The Guarantee places clear restrictions on what can be reimbursed. Losses resulting from ordinary wear and tear, gradual deterioration, or maintenance-related issues such as corrosion or equipment failure, are not covered. Damage that takes place after the scheduled booking period ends, or arises from unauthorized use of the studio, is likewise excluded from coverage. The Guarantee does not apply to losses stemming from criminal actions, gross negligence, or unlawful behavior—including damages created by smoking, use of contraband, or violation of statutory laws. Property that belongs to guests, attendees, outside contractors, or anyone other than the studio owner is not covered. The policy also excludes compensation for cash, securities, fine art, animals, vehicles, and electronic data. Studio owners should be aware that damages from natural disasters, war, terrorism, or governmental actions fall outside the scope of the Guarantee.
5. Coverage Limits and Payment Terms
Financial thresholds are firmly set under the Choira Guarantee. For any single booking, the maximum reimbursable amount is ₹20,00,000. Each individual item involved in a claim is subject to a cap of ₹8,00,000. To qualify for reimbursement, the total damage or repair cost must reach at least ₹10,000. If compensation has been received from guests, insurers, or any other party for the damaged property, these amounts will be deducted from the Guarantee payout. Therefore, only losses not otherwise compensated may be recovered under this program.
6. Studio Owner Responsibilities after Damage Occurs
Studio owners must take swift and appropriate action if property damage occurs during a booking. Securing the studio space and preventing additional loss is a primary responsibility; move equipment away from potential hazards and restrict access to the damaged area if necessary. Immediate and thorough documentation is vital. Take photographs of all damaged items and areas as soon as possible after discovery. For incidents involving criminal conduct such as theft or vandalism, submit a police report and retain a copy for your records. Collect all bills, repair quotes, receipts, and any relevant documentation related to damages and repairs. Preservation and organization of evidence will be crucial for supporting your claim with Choira.
7. How to Submit a Claim — the Detailed Claim Process
To begin a claim for damage under the Guarantee, studio owners must submit a reimbursement request within 14 days of the end of the booking. The claim should be filed through the Choira platform and include comprehensive supporting documents: clear photographs, repair or replacement receipts, official police reports if applicable, and a detailed list of all affected property with full specifications. Additionally, disclose any compensation or payments already received from other sources. If Choira requests supplementary information or inspection of the damaged premises, studio owners should respond promptly and allow reasonable access for verification. Accurate and honest disclosure is fundamental to a smooth claim process, and incomplete submissions may lead to denial.
8. Decision, Payment, and Settlement
After a claim and all supporting evidence have been submitted, Choira will review the materials and reach a decision within a reasonable period. Approved claims will result in reimbursement to the studio owner, within the program’s established coverage limits. Once a payment is received, that claim is considered completely and finally settled. If lost or stolen property is later recovered, the studio owner must notify Choira for adjustment of the final settlement or possible property return. Payments are disbursed within 60 days following the determination of eligibility and liability.
9. Fraud, Misrepresentation, and Non-Compliance
Honesty and full compliance are mandatory for studio owners. Any fraudulent activity or misrepresentation in relation to a claim will result in the denial of coverage, and may lead to suspension or termination of Guarantee participation and closure of the studio owner’s Choira account. Failure to cooperate fully and transparently with Choira during claim submission or investigation is grounds for ineligibility. Studio owners must always provide truthful, complete, and accurate information to maintain standing under the Guarantee.
10. Changes, Waivers, and Termination of Guarantee
Choira retains the right to modify, suspend, or terminate the Guarantee and these terms at any time. Notification of such changes will be provided through the Choira platform or by email—and continued participation will signify acceptance of the revised terms. Any amendments or waivers must be confirmed in writing by Choira. If coverage for a particular studio owner is to be suspended or terminated, Choira will give prior notice specifying the effective date and related details.
